‘Moist’ lawsuit before judge next week

The first court meeting in a lawsuit objecting to the "moist" vote will be next week, at 9 a.m. on the 10th before Special Judge Julia H. Adams, of Richmond.

In a special election last November the Lake and Jamestown precincts passed a measure to allow the sale of alcoholic beverages in restaurants, with certain restrictions.

The lawsuit objects to the way the election was held and the questions on the ballot, among other things.

There were motions filed in the case, including one to remove one of the defendants, Circuit Judge Vernon Miniard, as protected from such suits by judicial immunity.

Miniard has said, he is protected against such suits and has indicated there are other issues with the suit.

In a motion from his attorney Robert Bertram, Greg Shaw, a local businessman, has petitioned to enter the suit as a defendant.

Other filings include a motion to remove several of the plaintiffs since they don't live in the precincts and according to the filing they therefore have no standing to file such a suit.

Meanwhile in Trigg County a judge this week has allowed an alcohol question to reach voters in precincts, rather than a city or entire county vote.
